These Terms of Sale apply to purchases, quote requests, product inquiries, commercial orders, bulk orders, and other transactions with Restore Max Chemicals, also referred to as “RestoreMax Chemicals,” “Restore Max,” “we,” “us,” or “our.”
By placing an order, requesting a quote, submitting a product inquiry, purchasing through our website, accepting an invoice, or otherwise buying products from Restore Max Chemicals, you agree to these Terms of Sale.
Please read these terms carefully before purchasing or using any Restore Max Chemicals product.
1. Intended Users and Product Applications
Restore Max Chemicals supplies industrial cleaning, restoration, degreasing, concrete-removal, wash-down, detailing, and equipment-maintenance chemical products.
Our products are designed primarily for professional, commercial, industrial, agricultural, fleet, contractor, rental-equipment, concrete, equipment-maintenance, and heavy-equipment cleaning applications.
Products may also be purchased or used by individual equipment owners for personal equipment, personal vehicles, farm equipment, trailers, machinery, tools, or other approved applications.
Whether you purchase or use our products for business, commercial, professional, agricultural, fleet, industrial, or personal equipment use, you agree that you are responsible for safe handling, proper storage, surface testing, correct application, appropriate personal protective equipment, and following all product labels, Safety Data Sheets, Technical Data Sheets, warnings, and written instructions.
Restore Max Chemicals products are not intended for use by children or unauthorized users. Products should be kept out of reach of children, pets, and anyone who is not capable of safely handling chemical products.
2. Personal or Non-Commercial Use
If you purchase or use Restore Max Chemicals products for personal, non-commercial, hobby, residential, farm, equipment-owner, or individual use, you are still bound by these Terms of Sale.
Personal or non-commercial use does not remove your responsibility to:
- Read and follow all label directions
- Review the SDS/TDS before use when available
- Wear appropriate personal protective equipment
- Test on a small, inconspicuous area before full application
- Confirm the product is suitable for the surface
- Avoid unsuitable surfaces
- Use proper dilution, dwell time, agitation, and rinse procedures
- Store products safely
- Keep products away from children and pets
- Avoid mixing chemicals
- Dispose of product, residue, towels, containers, and wastewater according to applicable rules
Restore Max Chemicals is not responsible for damage, injury, poor results, surface damage, staining, corrosion, discoloration, equipment damage, environmental issues, or other losses caused by misuse, improper dilution, failure to test first, failure to follow directions, improper storage, use on incompatible surfaces, mixing chemicals, or use outside the product’s intended application.
Order Acceptance
Submitting an order, quote request, checkout payment, or product inquiry does not guarantee acceptance of the order. Restore Max Chemicals reserves the right to accept, reject, cancel, delay, or modify any order for reasons including product availability, pricing errors, incorrect product information, payment issues, suspected fraud, shipping restrictions, hazardous material restrictions, destination restrictions, unavailable delivery service, safety concerns, compliance concerns, unusual order quantity, or any other reason determined by Restore Max Chemicals. If we cancel an order after payment has been collected, we will issue a refund for the canceled portion of the order.
3. Quotes and Bulk Pricing
Bulk pricing, freight pricing, commercial pricing, wholesale pricing, and custom quotes are provided on a case-by-case basis.
Quotes may depend on:
- Product type
- Quantity
- Container size
- Order frequency
- Delivery location
- Freight cost
- Packaging requirements
- Product availability
- Payment terms
- Special handling requirements
- Whether the order includes 5-gallon pails, 55-gallon drums, 275-gallon totes, pallets, or custom quantities
Unless otherwise stated in writing, quotes are estimates and may be subject to change before final order approval.
Restore Max Chemicals may revise or withdraw a quote if product costs, freight rates, taxes, fees, availability, shipping requirements, or customer order details change.
4. Pricing and Product Availability
Prices are subject to change without notice.
We make reasonable efforts to keep product information, pricing, availability, descriptions, and images accurate, but errors may occur. Restore Max Chemicals reserves the right to correct errors, update product information, change pricing, or cancel orders affected by inaccurate information.
Product availability is not guaranteed until the order has been accepted, processed, and confirmed.
Some products may be temporarily unavailable, backordered, discontinued, special-order only, or subject to lead times.
5. Payment Terms
Payment is due according to the checkout page, invoice, written quote, or approved payment arrangement.
Orders may not be processed, packaged, staged, shipped, released, or delivered until payment is received and cleared unless Restore Max Chemicals has approved written credit terms.
For commercial accounts, approved payment terms must be agreed to in writing. Restore Max Chemicals may suspend, cancel, or delay orders if payment is late, declined, disputed, incomplete, reversed, or otherwise not received.
The customer is responsible for all applicable taxes, shipping charges, freight charges, accessorial fees, handling fees, and other charges related to the order unless otherwise stated in writing.
6. Taxes
Customers are responsible for applicable sales tax, use tax, excise tax, local tax, or other taxes associated with the order.
If a customer claims tax-exempt status, the customer must provide valid tax-exemption documentation before the order is processed. Restore Max Chemicals may reject or delay tax-exempt processing until acceptable documentation is received.
7. Shipping, Freight, and Delivery
Shipping and delivery are governed by our Shipping Policy, which is incorporated into these Terms of Sale.
Shipping costs, freight costs, delivery options, and delivery timeframes may vary based on product type, quantity, container size, destination, carrier availability, freight requirements, chemical classification, and special handling needs.
Bulk, pallet, drum, tote, commercial, or high-volume orders may require freight coordination and may not be eligible for standard parcel shipping.
Delivery dates and shipping timeframes are estimates unless expressly guaranteed in writing by Restore Max Chemicals.
Restore Max Chemicals is not responsible for carrier delays, freight delays, weather delays, incorrect addresses, unavailable recipients, failed delivery attempts, accessorial charges, storage fees, re-delivery fees, or delays caused by events outside our control.
8. Risk of Loss
Unless otherwise stated in writing, risk of loss passes to the customer when the product is delivered to the shipping address, picked up by the customer, transferred to the customer’s carrier, or transferred to a shipping or freight carrier for delivery.
Customers are responsible for inspecting shipments upon delivery and promptly reporting damaged, leaking, missing, or incorrect products according to our Shipping Policy and Refund and Returns Policy.
9. Chemical Shipping Restrictions
Some products may be subject to special shipping, packaging, labeling, documentation, handling, carrier, or destination restrictions.
Restore Max Chemicals reserves the right to modify, delay, or cancel an order if we determine that a product cannot be shipped safely, legally, or according to carrier requirements.
Customers may not return, reship, repackage, relabel, transfer, or forward chemical products without written authorization and instructions from Restore Max Chemicals.
Do not attempt to ship damaged, leaking, opened, contaminated, diluted, transferred, or improperly stored chemical products.
10. Product Use and Customer Responsibility
Customers are responsible for using all products safely, properly, and only for suitable applications.
Before using any product, customers must:
- Read the product label
- Review the Safety Data Sheet, if applicable
- Follow all instructions and warnings
- Use appropriate personal protective equipment
- Test on a small, inconspicuous area before full application
- Confirm surface compatibility
- Use proper dilution, dwell time, agitation, and rinse procedures
- Avoid unsuitable surfaces
- Follow workplace safety rules
- Follow environmental, disposal, and site requirements
- Store products properly
- Keep containers closed when not in use
- Keep products away from children and unauthorized users
Restore Max Chemicals is not responsible for damage, injury, loss, or poor results caused by misuse, improper dilution, improper application, using a product on an unsuitable surface, failure to test first, failure to follow directions, improper storage, freezing, overheating, contamination, mixing chemicals, transferring products into other containers, or using products outside their intended purpose.
11. Labels, SDS, and Safety Information
Product labels, Safety Data Sheets, Technical Data Sheets, instructions, warnings, and written guidance are provided to help customers understand product use, hazards, precautions, storage, handling, and application.
Customers are responsible for reviewing and following all applicable safety information before use.
If there is any conflict between website marketing language and a product label, SDS, or written safety instruction, the product label, SDS, and written safety instruction control.
Customers are also responsible for providing appropriate safety information, training, personal protective equipment, and workplace hazard communication to their own employees, workers, contractors, or users as required by applicable law.
12. Surface Compatibility and Testing
Chemical performance and surface compatibility can vary depending on product type, surface type, material condition, age, coating, paint, temperature, exposure time, dilution, contamination, previous chemical use, and application method.
Always test products on a small area before full application.
Do not assume a product is safe for all surfaces.
Restore Max Chemicals is not responsible for damage to paint, decals, polished metals, chrome, aluminum, glass, plastics, rubber, wiring, seals, coatings, concrete, asphalt, finished surfaces, or any other material if the product is misused, over-applied, left on too long, used at the wrong dilution, used on an unsuitable surface, or used without proper testing.
13. No Mixing of Chemicals
Do not mix Restore Max Chemicals products with other chemicals unless Restore Max Chemicals provides written instructions approving the specific mixture.
Mixing chemicals can create dangerous reactions, hazardous fumes, pressure buildup, product failure, surface damage, or other unsafe conditions.
Restore Max Chemicals is not responsible for any damage, injury, contamination, disposal issue, environmental issue, or product failure caused by mixing products with other chemicals, additives, water sources, residues, unknown substances, or transferred containers.
14. Product Results
Restore Max Chemicals designs and supplies products for industrial cleaning, equipment maintenance, concrete buildup removal, degreasing, wash-down, and related applications.
However, results are not guaranteed in every situation.
Product performance may depend on:
- Type of buildup
- Age of buildup
- Thickness of contamination
- Surface condition
- Temperature
- Dwell time
- Dilution
- Agitation
- Rinsing method
- Water quality
- Application equipment
- Storage condition
- Prior chemical exposure
- User skill and procedure
Restore Max Chemicals does not guarantee that any product will remove every stain, buildup, deposit, coating, residue, grease, oil, concrete deposit, contaminant, or marking from every surface.
15. Product Descriptions and Images
Product descriptions, images, application examples, before-and-after examples, website content, product recommendations, and marketing materials are for general informational purposes only.
Images and examples may not represent every possible result, surface, condition, or application.
Customers should not rely solely on website content when determining whether a product is suitable for a specific use. Customers should review the product label, SDS, TDS, written instructions, and perform a test area before full application.
16. Product Recommendations
Restore Max Chemicals may provide product recommendations based on information supplied by the customer.
Recommendations are based on the information available at the time and are not a guarantee of results.
Customers are responsible for confirming suitability, testing first, following directions, and using the product safely.
If the customer provides incomplete, inaccurate, or misleading information about the surface, equipment, contamination, prior chemicals, jobsite, storage, or application, Restore Max Chemicals is not responsible for poor results, damage, injury, or loss.
17. Returns and Refunds
Returns and refunds are governed by our Refund and Returns Policy, which is incorporated into these Terms of Sale.
Because Restore Max Chemicals sells chemical cleaning, restoration, and detailing products, returns are stricter than standard retail returns.
Opened, used, leaking, damaged, contaminated, diluted, transferred, frozen, overheated, tampered-with, improperly stored, or unauthorized returned products are not eligible for return.
Bulk, drum, tote, pallet, wholesale, commercial, custom, special-order, clearance, discounted, or promotional purchases may not be eligible for return or refund unless approved in writing by Restore Max Chemicals.
Do not ship any product back without written return authorization and return instructions.
Return approval may depend on product classification, container condition, shipping restrictions, hazardous material requirements, and whether the product can be legally and safely transported.
18. Damaged, Defective, Leaking, Missing, or Incorrect Orders
If your order arrives damaged, defective, leaking, missing items, or incorrect, contact Restore Max Chemicals within 48 hours of delivery.
Customers must provide:
- Order number
- Photos of the product
- Photos of the packaging
- Photos of the shipping label or bill of lading
- Description of the issue
- Quantity affected
- Delivery date
If the issue is verified, Restore Max Chemicals may provide a replacement, refund, credit, or other resolution depending on the situation.
Do not use, discard, return, dilute, transfer, or reship damaged or leaking product unless Restore Max Chemicals provides instructions.
19. Cancellations
Order cancellation requests must be submitted as soon as possible.
Restore Max Chemicals may not be able to cancel an order once it has been processed, packaged, staged, shipped, blended, produced, special ordered, palletized, loaded, or transferred to a carrier.
Bulk, drum, tote, pallet, wholesale, commercial, custom, or special-order purchases may not be cancellable once processing has begun.
If cancellation is approved, the refund amount may be reduced by non-refundable costs already incurred, including shipping, freight, packaging, handling, payment processing, restocking, special-order costs, or carrier fees.
20. Unauthorized Resale, Relabeling, and Repackaging
Unless expressly authorized in writing by Restore Max Chemicals, customers may not:
- Resell products under another name
- Repackage products
- Relabel products
- Remove product labels
- Alter warnings or instructions
- Transfer products into unapproved containers for resale
- Represent themselves as an authorized distributor
- Make unauthorized claims about Restore Max Chemicals products
- Use Restore Max Chemicals branding in a misleading way
Unauthorized repackaging, relabeling, resale, or claim-making may create safety, regulatory, and liability risks.
21. Environmental and Disposal Responsibility
Customers are responsible for using and disposing of products, residues, wastewater, used towels, containers, contaminated materials, and waste according to applicable laws, site rules, workplace policies, and environmental requirements.
Restore Max Chemicals is not responsible for improper disposal, wastewater handling, runoff, contamination, spills, site violations, or environmental claims caused by customer use, misuse, storage, disposal, or handling.
22. Warranty Disclaimer
To the fullest extent permitted by law, Restore Max Chemicals products are provided “as is” and “as available,” except for any written warranty expressly provided by Restore Max Chemicals.
Restore Max Chemicals disclaims all implied warranties to the fullest extent permitted by law, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, and suitability for a specific application.
No employee, representative, agent, distributor, website statement, advertisement, product description, email, phone call, or recommendation creates a warranty unless expressly stated in a written warranty signed or approved by Restore Max Chemicals.
Some states do not allow limitations on implied warranties, so some limitations may not apply to every customer.
Nothing in these Terms limits any rights that cannot be waived under applicable law.
23. Limitation of Liability
To the fullest extent permitted by law, Restore Max Chemicals will not be liable for indirect, incidental, special, consequential, punitive, or exemplary damages, including loss of profits, lost revenue, downtime, equipment damage, surface damage, business interruption, loss of use, labor costs, replacement costs, environmental cleanup costs, or third-party claims arising from product use, misuse, shipping, storage, application, or inability to use the product.
To the fullest extent permitted by law, Restore Max Chemicals’ total liability for any claim related to a product or order will not exceed the amount paid by the customer for the specific product giving rise to the claim.
This limitation does not apply where prohibited by law.
24. Indemnification
To the fullest extent permitted by law, the customer agrees to defend, indemnify, and hold harmless Restore Max Chemicals, its owners, employees, contractors, suppliers, service providers, and representatives from any claims, damages, losses, liabilities, costs, or expenses arising from:
- Customer misuse of products
- Failure to follow directions
- Failure to review SDS or label instructions
- Improper dilution
- Improper application
- Improper storage
- Improper disposal
- Use on unsuitable surfaces
- Failure to test first
- Mixing chemicals
- Unauthorized relabeling or repackaging
- Unauthorized resale
- Customer-provided inaccurate information
- Customer violation of laws or regulations
- Claims by customer’s employees, contractors, customers, or third parties
25. Force Majeure
Restore Max Chemicals will not be responsible for delays, failures, losses, or damages caused by events outside our reasonable control, including but not limited to:
- Weather
- Natural disasters
- Carrier delays
- Freight disruptions
- Supply shortages
- Labor shortages
- Equipment failure
- Power outages
- Cybersecurity incidents
- Government actions
- Regulatory restrictions
- War, terrorism, civil unrest, or emergencies
- Accidents
- Pandemics or public health events
- Raw material shortages
- Manufacturer delays
- Events affecting product availability, shipping, or fulfillment
26. Website Content and Intellectual Property
All website content, product names, text, graphics, photos, logos, designs, icons, product descriptions, and other materials on the Restore Max Chemicals website are owned by or licensed to Restore Max Chemicals unless otherwise stated.
You may not copy, reproduce, distribute, modify, display, sell, or use website content for commercial purposes without written permission from Restore Max Chemicals.
27. User-Submitted Content
If you submit reviews, testimonials, photos, videos, before-and-after images, comments, or other content to Restore Max Chemicals, you represent that you have the right to submit that content.
You grant Restore Max Chemicals permission to use submitted content for customer service, marketing, website display, social media, training, product improvement, and business purposes, unless otherwise agreed in writing.
Do not submit content that includes another person’s personal information, another company’s confidential information, protected logos, jobsite information, license plates, or images you do not have permission to share.

By submitting information through our website, forms, checkout, email, phone, or other communication channels, you agree to the practices described in our Privacy Policy.
29. Governing Law
These Terms of Sale are governed by the laws of the State of Oklahoma, without regard to conflict-of-law principles.
Any dispute related to these Terms of Sale, products, orders, quotes, or transactions with Restore Max Chemicals shall be handled in a court or forum with proper jurisdiction over Restore Max Chemicals’ principal place of business, unless otherwise required by applicable law.

Restore Max Chemicals may update these Terms of Sale from time to time.
When we update these terms, we will revise the “Last Updated” date at the top of this page.
The version posted at the time of purchase or order acceptance applies to that order unless otherwise required by law or agreed in writing.
